Flixfox functions strictly as a Passive Intermediary and Information Location Tool, indexing only metadata from the public web.Our platform serves as a sophisticated directory that indexes publicly available third-party links from across the internet to help users find content more efficiently.

1. Our Commitment To Intellectual Property

We maintain a profound respect for the creative industry in India and globally. Flixfox is committed to supporting the hard work of content creators, ranging from major Bollywood production houses and regional cinema studios to international sports leagues like the IPL and ICC.

In accordance with the Copyright Act, 1957 (India) and the Digital Millennium Copyright Act (DMCA), we have established a clear and transparent process for rights holders to request the removal of infringing links from our search index.

2. Intermediary Status And Safe Harbor

As a digital intermediary, Flixfox operates within the "Safe Harbor" protections provided by Section 79 of the Information Technology Act, 2000. We do not initiate the transmission, select the receiver of the transmission, or select or modify the information contained in the transmission. Our role is strictly limited to providing a technical search service for links already existing on the public web.

3. Requirements For A Valid Takedown Notice

To submit a formal request for the removal of an indexed link, the copyright owner or their authorized representative must provide a written communication. For your notice to be legally valid, it must include the following specific details:

  • Identification of the Work: Clear identification of the copyrighted material you believe has been infringed.
  • Location Evidence: The exact URL or technical link within the Flixfox app that leads to the third-party source you wish to have removed.
  • Authorized Signature: A physical or electronic signature of the person authorized to act on behalf of the owner.
  • Contact Information: Your full legal name, physical address, telephone number, and official email address.
  • Good-Faith Statement: A statement that you have a "good-faith belief" that the use of the material is not authorized by the copyright owner or the law.
  • Accuracy Statement: A statement made under penalty of perjury that the information in the notification is accurate.

4. Counter-Notification And Fair Use

If you are a user or content provider and believe your link was removed by mistake or through misidentification, you may file a Counter-Notification. Under the Copyright Act, 1957, Indian law recognizes the principle of "Fair Dealing."

Your counter-notice must include your identification, a description of the material removed, and a statement that you have a good-faith belief that the removal was an error. Flixfox will review such notices and may reinstate the index result if the legal criteria are met.

5. Strict Three-Strike Policy

To protect our ecosystem and discourage unauthorized distribution, Flixfox enforces a rigorous Three-Strike Policy for repeat offenders:

  • Strike 1 (Warning): If a third-party domain is flagged for a valid infringement, we issue a formal warning and filter the specific result from our index.
  • Strike 2 (Suspension): Continued violations from the same third-party source result in a 30-day suspension of all results from that domain.
  • Strike 3 (Permanent Ban): Persistent or systemic copyright violations will result in the permanent blacklisting of the third-party source from our Android-based search index.

6. Official Submission Channel

Please send all copyright-related inquiries and formal takedown notices to our official legal correspondence portal on our website. We aim to acknowledge all valid requests within 24 hours and finalize the removal of infringing links within 48 hours of verification.
